Personal data is defined as “any information relating to an identified or identifiable natural person (data subject)” – GDPR
In accordance with these laws (GDPR, Part 3 of the Data Protection Act 2018), JMCrocker is a “Data Controller”. As such, JMCrocker takes on the responsibility of ensuring the rights of data subjects and the protection of personal data processed.
Further definition of personal data:
“Personal Data” is any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier such as a user IP
addresses or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person and includes Special Categories of Personal Data;
“Special Categories of Personal Data” is any Personal Data that reveals racial or
ethnic origin, political opinions, religious or philosophical beliefs, trade-union
membership; data concerning health or sex life and sexual orientation; genetic
data or biometric data.
Sources of Personal Data Collected and Processed
As a business consultancy JMCrocker necessarily collects, processes, and stores related personal data from our customers, staff, other public bodies, and service providers. In particular contact details for clients, and regulatory documentation for companies to ensure their identities in accordance with the relevant legislation.
Purposes for which we hold and retain your personal data
As a consultancy that deals largely in highly regulated fields we have a staunch belief in transparency and security of personal data. Depending on the service and market you or your company operates in, differing legislation will apply. To that effect, we have created service specific privacy notices that can be found in the appendices of this policy. In the event that you avail of multiple services, we will continue to follow the notices hereof. As a general rule, we do not hold any personal data for longer than it is needed to carry out the requested services and maintain compliance with applicable law.
Disclosure of Your Personal Data
When necessary and in performance of our duties we may need to share your information with third-party companies. This will be in strict performance of our duties and will never be done in an attempt to sell or otherwise market with your data. You will be informed beforehand if we think that our duties will require us to share your data and a separate agreement will be supplied to ensure that you are informed every step of the way. Specific duties that may require disclosure of your information are listed in the service notice appendices hereof.
Transfers of your data outside the EU
We will never actively transfer your data outside of the EEA and will endeavour to only use storage facilities and software that house their data therein. In the case where we are made aware that said facilities are moved outside the EEA, we will ensure that the appropriate measures are in place to comply with our obligations under applicable laws governing such transfers or seek, at the earliest opportunity, to transfer to a new service provider within the EEA.
Keeping your Personal Data secure
JMCrocker is committed to ensuring the safety and security of your data during administrative processes and storage thereafter, where necessary by applicable law. All technical, hardware and software, measures have been put in place to strengthen and maintain the highest level of security for your personal data.
Rights of individuals in relation to personal data held by JMCrocker
Each individual has rights to their own personal data, no matter when or how it is given. These rights are outlined below and can be exercised at any point by contacting our Data Protection Officer indicating which right(s) you would like to exercise:
- right to be informed and the right of access;
- right to rectification;
- right to erasure;
- right to restrict processing;
- right to data portability;
- right to object to processing;
- rights in relation to automated decision making and profiling.
In the rare occurrence where applicable law dampens or does not allow full use of the rights listed above, you will be informed within 72 hours of the request made with a full explanation of the applicable law.

Retention
JMCrocker only holds your data for as long as strictly necessary in performance of our duties and in line with any applicable law of the services that are being rendered. The retention of your data may differ dependent on the services provided and is further detailed in the service notice appendices hereof. Where compliance to the law or regulation, a summons, a search warrant, a court or regulatory order, or other statutory requirement, is required, we will hold your data for only as long as is required to ensure compliance.
Queries and Complaints
The Data Protection Officer for JMCrocker is Jess McKenzie-Crocker. If you have a query, concern or complaint regarding a data protection matter, the most effective and efficient way to contact the Data Protection Officer is to email data.protection@jmcrocker.com with “Data Protection” somewhere in the subject.
You also have the right to make a complaint to the Data Protection Commision if you consider that processing of your personal data is contrary to GDPR.

Media
If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Who we share your data with
If you request a password reset, your IP address will be included in the reset email.
How long we retain your data
If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.
For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.
What rights you have over your data
If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us.
